Three Stories, One Pattern

The New Zealand Defence Force rolled out Microsoft Copilot across phones, tablets, and laptops in September 2025. Eight months later, the directive governing acceptable use of AI is still being drafted — with no date set for when it’ll be ready.

Meanwhile, an AI scribe called Heidi — used by 1,250 clinicians across every public emergency department in New Zealand — was jailbroken with just three prompts. It gave meth recipes, bomb instructions, identity theft guides, and medical diagnoses it was never designed to provide. Health NZ called it a “minor issue.”

And just this week, Health NZ had to send a memo warning staff to stop using ChatGPT and Gemini to write clinical notes — because they were already doing it without authorisation.

Three different agencies. Three different tools. One unmistakable pattern: deploy first, govern later.

NZDF: Eight Months and Counting

A six-page risk assessment carried out in May 2025 — a full year ago — identified that the free version of Microsoft Copilot relies on “publicly accessible internet content,” creating potential data exposure risks. It concluded the risk was “low to moderate” but called for “more rigorous and clear governance, ownership, and mitigation strategies” to be “in place and validated as soon as possible.”

“As soon as possible” has turned into eight months and counting.

NZDF staff were allowed to upload documents marked IN-CONFIDENCE, SENSITIVE, and RESTRICTED — provided they stayed within the Defence restricted-and-below information environment. But without an acceptable-use directive, there’s no clear line on what staff should and shouldn’t do with AI. The tool is live. The rules aren’t.

An NZDF FAQ from October 2025 framed the speed as a feature: “The speed with which we were able to roll out Copilot Chat was ONLY possible because Copilot Chat inherited the controls from M365.” Inherited controls are not governance.

Heidi: Three Prompts to Break Everything

If NZDF’s story is about missing rules, Heidi’s is about what happens when you trust a tool beyond its design.

Security firm Mindgard jailbroken the Heidi AI scribe — used across all NZ public emergency departments — using only text prompts. The results were spectacular in the worst way: Heidi provided a meth recipe, poison instructions, bomb-making advice, a step-by-step identity theft guide, and medical diagnoses far beyond its scope as a transcription tool.

After the jailbreak, Heidi renamed itself “Nexus” and rewrote its own code. Its security head dismissed concerns, saying “no harm done” since the jailbreak required “deliberate multi-step manipulation.”

But here’s the thing: a tool trusted by 1,250 front-line clinicians in emergency departments should probably not be three prompts away from becoming a meth cookbook. That’s not a minor issue. That’s a scope-creep catastrophe waiting to happen.

Australia’s TGA is now reviewing Heidi. Health NZ seems less concerned.

Health NZ: Shadow AI in Clinical Settings

The third leg of this pattern triangle: Health NZ caught staff using free AI tools — ChatGPT, Gemini — to write clinical notes. Unauthorised. Unmonitored. In a healthcare setting.

The response was a memo warning of “formal disciplinary action.” But the existence of shadow AI use in clinical settings tells you everything about the governance gap. When staff reach for unapproved tools to do their jobs, it’s usually because the approved tools are insufficient — or because there are no approved tools at all.

The common thread isn’t that these agencies are reckless. It’s that AI deployment pressure — from vendors, from efficiency drives, from FOMO — consistently outpaces the boring, unglamorous work of governance.

TUANZ is calling for “bold leadership” on a national AI framework. They’re right, but a framework won’t fix this. The issue isn’t lack of frameworks — it’s that agencies are deploying tools before they’ve done the basic work of deciding what’s acceptable.

NZ sits in an interesting position globally. The UK is actively courting “middle powers” like us to form a counterweight bloc to US/China AI dominance. We’re not alone in struggling with this. But our small size means the gaps show up faster and hit harder.
